1. Agreement to Terms
By accessing or using the services of Sa Sandbag Solutions PTY (Ltd) ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services or purchase our products.
2. Products and Services
We manufacture and sell geotextile sandbags for various applications including, but not limited to, agriculture, construction, erosion control, and flood mitigation. All product specifications, descriptions, and images are provided for general information purposes only.
3. DISCLAIMER OF LIABILITY AND WARRANTIES
3.1 Product Suitability
THE CUSTOMER IS SOLELY RESPONSIBLE FOR DETERMINING THE SUITABILITY OF OUR PRODUCTS FOR THEIR INTENDED APPLICATION. We do not test, certify, or warrant our products for any specific use, including but not limited to:
- Flood control or flood prevention
- Structural support in construction
- Erosion control or soil stabilization
- Load-bearing applications
- Safety-critical applications
- Any application where failure could result in injury, death, or property damage
3.2 No Warranty of Fitness
OUR PRODUCTS ARE SOLD "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We make no representations or warranties regarding:
- The performance of products in specific environmental conditions
- The durability or longevity of products in any application
- The effectiveness of products for flood control, erosion prevention, or any other purpose
- The structural integrity or load-bearing capacity of products
3.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SA SANDBAG SOLUTIONS PTY (LTD) SHALL NOT BE LIABLE FOR ANY:
- Direct, indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Property damage, personal injury, or death
- Damage resulting from flood, water intrusion, structural failure, or erosion
- Claims arising from the use, misuse, or inability to use our products
- Failure of products to perform as expected in any application
3.4 Professional Advice Required
CUSTOMERS MUST SEEK PROFESSIONAL ENGINEERING, CONSTRUCTION, OR OTHER EXPERT ADVICE before using our products in any application where failure could result in harm or damage. We are not engineers and do not provide engineering, construction, or professional advice.
3.5 Testing and Certification
We do not conduct independent testing of our products for specific applications. We do not certify our products for any particular use. Any information provided about product specifications is for general reference only and should not be relied upon for critical applications.
3.6 Maximum Liability Cap
In any event, our total liability shall not exceed the purchase price paid by the customer for the specific products giving rise to the claim.
4. Customer Responsibilities
By purchasing our products, you acknowledge and agree that:
- You are solely responsible for determining if our products are suitable for your intended use
- You will obtain professional engineering or technical advice where appropriate
- You will conduct your own testing and evaluation of products before deployment
- You will use products in accordance with applicable laws, regulations, and industry standards
- You assume all risks associated with the use of our products
- You will not use products in applications where failure could endanger life or property without proper professional engineering oversight
5. Indemnification
You agree to indemnify, defend, and hold harmless Sa Sandbag Solutions PTY (Ltd), its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of our products
- Your failure to obtain professional advice
- Your violation of these Terms of Service
- Any damage or injury resulting from the use of our products
6. Orders and Payment
6.1 Order Acceptance
All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including product availability, errors in pricing or product information, or suspected fraudulent activity.
6.2 Pricing
Prices are subject to change without notice. The price charged will be the price displayed at the time of order confirmation. All prices are in South African Rand (ZAR) and include VAT unless otherwise stated.
6.3 Payment
Payment must be made in full before products are shipped unless alternative arrangements have been made in writing.
7. Shipping and Delivery
Delivery times are estimates only and are not guaranteed. We are not liable for delays in delivery. Risk of loss and title for products pass to the customer upon delivery to the carrier.
8. Returns and Refunds
Products may be returned within 14 days of delivery in unused, original condition. Custom orders are non-refundable. Customers are responsible for return shipping costs unless the product is defective. Refunds will be processed within 14 business days of receiving returned products.
9. Product Defects
If products have manufacturing defects, we will replace or refund the defective products at our discretion. This is your sole and exclusive remedy for defective products. We are not liable for any consequential damages resulting from defective products.
10. Intellectual Property
All content on our website, including text, images, logos, and designs, is the property of Sa Sandbag Solutions PTY (Ltd) and is protected by South African and international intellectual property laws.
11. Privacy

12. Governing Law and Jurisdiction
These Terms of Service are governed by the laws of the Republic of South Africa. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of South Africa.

14. Changes to Terms
